Regulations state that a valid EPC is required at the “earliest opportunity or at least before entering into a contract to sell or rent out the property”
The penalty for failing to make an EPC available to any prospective buyer or tenant when selling or letting non-dwellings is fixed - 12.5% of the rateable value of the building. This is subject to a minimum penalty of £500 and a maximum of £5,000. A default penalty applies where a formula cannot be applied - £750.
An EPC will still be required.
These penalties are enforced by Trading Standards.
